Terms of Service

Welcome to PixGenX! By accessing our website, Web Studio, APIs, or our services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

1. Use of Service & Restrictions

PixGenX provides cloud-based AI image generation workflows via a Web Studio interface and a direct REST API.

• API Security: You must safeguard your API key. It is your sole responsibility to keep it confidential.
• Prohibited Conduct: You agree not to reverse engineer, scrape, or attempt to extract our underlying AI model weights. You agree not to use our Service (Web or API) to generate abusive, illegal, explicit, or non-consensual content.
• No Web Studio Automation: The Web Studio interface is strictly for manual, human interaction. The use of automated scripts, macros, or bots to generate images via the Web Studio to bypass API billing is strictly prohibited and will result in immediate account termination without refund.

2. Intellectual Property & Commercial Use

You own the output. Any images you generate using PixGenX are yours to use commercially or non-commercially. PixGenX claims no copyright over the images generated by your prompts. However, you are solely responsible for ensuring your prompts and outputs do not infringe on third-party trademarks, copyrights, or publicity rights.

3. Platform SLAs and Content Storage

While we strive for 99.9% uptime of our infrastructure, we do not guarantee uninterrupted access and are not liable for losses caused by generation downtime or third-party cloud provider outages.

Web Studio Storage: Images generated via our Web Studio interface are securely stored in your personal Gallery according to your purchased tier (e.g., 10 GB for Pro accounts, 100 MB for Starter accounts).

API Ephemeral Storage (24h TTL): PixGenX's direct REST API endpoints are designed for pipeline execution, not long-term storage. Images generated via API calls operate on a strict 24-hour Time-To-Live (TTL). After 24 hours, they are permanently wiped from our systems. You are responsible for downloading and backing up API assets promptly.

4. Billing, Subscriptions, & API Packs

PixGenX offers recurring subscriptions, One-Time Payment (Lifetime) licenses, and API Packs.

• API Packs: Direct API requests are strictly billed via API Packs (Pay-as-you-go). API generation does not deduct from your Web Studio allocation. All API Pack purchases are final and non-refundable once credits are used.
• Payments: Payments are securely processed via our merchant of record (e.g., Stripe/Freemius). Chargebacks or payment disputes without prior contact with our support team will result in permanent account bans.

5. Fair Use Policy (FUP) & Resource Limits

To ensure high speeds and server stability for all users, "Unlimited" generations inside the Web Studio (for Pro or Lifetime tiers) are subject to a strict Fair Use Policy.

• "Unlimited" refers to standard, manual generation by a single human user.
• PixGenX reserves the right to impose dynamic technical limits—including rate-limiting (throttling), queue priority, or temporary cooldowns—if a user generates an abnormally high volume of requests in a short period.
• Economic Viability Clause: If a user’s Web Studio usage creates a disproportionate financial burden on our infrastructure (defined as usage costs exceeding 500% of the average user's compute cost), PixGenX reserves the right to throttle speed, restrict access, or require the user to purchase API credits to continue generating.

6. Lifetime License Addendum

If you purchase a "Lifetime" or "One-Time Payment" plan, the following specific terms apply and supersede any conflicting terms:

• Web Studio Only: Lifetime licenses grant access exclusively to the Web Studio interface. API access is never included in Lifetime plans and must always be purchased separately via API Packs.
• Definition of "Lifetime": "Lifetime" refers strictly to the commercial lifespan of the specific product version (e.g., PixGenX Web Studio V1) available at the exact time of your purchase. It does not mean the lifetime of the purchaser, nor does it guarantee the perpetual existence of the PixGenX company. A Lifetime license applies only to the features and functionalities existing at the time of purchase. Future major version upgrades (e.g., V2.0) or entirely new standalone products may require a separate purchase or upgrade fee.
• End-of-Life (EOL): We reserve the right to sunset or discontinue the Product at any time. If the Product is designated End-of-Life, we will provide at least sixty (60) days’ notice. Upon expiration of this period, access will terminate and no refunds will be owed.
• Non-Transferable: Lifetime accounts are personal to the buyer. Account sharing, reselling, or transferring the account to a third party or agency will result in immediate termination.
